Purpose of this privacy policy

Rohan Solicitors LLP has developed this privacy notice to demonstrate our commitment to safeguarding the privacy of your information.

Please read this privacy policy carefully as it contains important information on who we are and how and why we collect, store, use and share your personal data. It also explains your rights in relation to your personal data and how to contact us or supervisory authorities in the event you have a complaint.

Rohan Solicitors LLP is a limited liability partnership registered in England and Wales under registered number OC382957, our registered office is at Aberdeen House, South Road, Haywards Heath, West Sussex RH16 4NG. When we use your personal data we are regulated under the General Data Protection Regulation (GDPR) which applies across the European Union (including in the United Kingdom) and we are responsible as ‘controller’ of that personal data for the purposes of the GDPR.  Our use of your personal data is subject to your instructions, the GDPR, other relevant UK and EU legislation and our professional duty of confidentiality.

Data Protection Principles 

We will comply with data protection law.  This says that the personal information we hold about you must be:

1.  Used lawfully, fairly and in a transparent way.

2.   Collected only for valid purposes that we have clearly explained to you and not used in any way that is incompatible with those purposes.

3.   Relevant to the purposes we have told you about and limited only to those purposes.

4.   Accurate and kept up to date.

5.   Kept only as long as necessary for the purposes we have told you about.

6.   Kept securely.

The types of personal information we collect:

Personal data, or personal information, means any information about an individual from which that person can be identified.  It does not include data where the identity has been removed (anonymous data).

We may collect, use, store and transfer different kinds of personal data about you which we have grouped together as follows:

  • Identity Data includes first name, maiden name, last name, username or similar identifier, marital status, title, date of birth and gender.
  • Contact Data includes postal address, e-mail address and telephone numbers.
  • Technical Data includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access this website.
  • Usage Data includes information about how you use our website, products and services.
  • Marketing and Communications Data includes your preferences in receiving marketing from us and our third parties and your communication preferences.

We also collect, use and share Aggregated Data such as statistical or demographic data for any purpose.  Aggregated Data could be derived from your personal data but is not considered personal data in law, as this data will not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website feature.  However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy policy.

We do not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data).  Nor do we collect any information about criminal convictions and offences.

How your personal information is collected:

We use different methods to collect data from and about you including through:

 Direct interactions.  You may give us your Identity, Contact and Financial Data by filling in forms or by corresponding with us by post, phone, email or otherwise.  This includes personal data you provide when you:

  • apply for our products or services;
  • subscribe to our publications;
  • request marketing to be sent to you;
  • enter a competition, promotion or survey; or
  • give us feedback or contact us.

Automated technologies or interactions.  As you interact with our website, we will automatically collect Technical Data about your equipment, browsing actions and patterns. We collect this personal data by using cookies, server logs and other similar technologies.

  • automated monitoring of our websites and other technical systems, such as our computer;
  • networks and connections, communications systems, email and instant messaging systems. 

How and why we will use your personal information:

We will only use your personal data when the law allows us to.  Most commonly, we will use your personal data in the following circumstances:

  • Where we need to perform the contract we are about to enter into or have entered into with you.
  • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests. Legitimate Interest means the interest of our business in conducting and managing our business to enable us to give you the best service and the best and most secure experience.
  • Where we need to comply with a legal obligation.

Generally, we do not rely on consent as a legal basis for processing your personal data.

Who we share your personal information with:

We may share your personal data with the parties set out below for the purposes set out in the table above.

  • Service providers acting as processors who provide IT and system administration services.

We require all third parties to respect the security of your personal data and to treat it in accordance with the law.  We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

International transfers:

We do not transfer your personal data outside the European Economic Area (EEA).

Marketing:

We strive to provide you with choices regarding certain personal data uses, particularly around marketing and advertising.  We may use your personal data to form a view on what we think you may want or need, or what may be of interest to you.  This is how we decide which products, services and offers may be relevant for you (we call this marketing).

You will receive marketing communications from us if you have requested information from us or purchased services from us and you have not opted out of receiving that marketing.

Opting out:

You can ask us to stop sending you marketing messages at any time by contacting us.  Where you opt out of receiving these marketing messages, this will not apply to personal data provided to us as a result of a service purchase or other transactions.

Cookies:

Data security:

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed.  In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know.  They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

How long your personal information will be kept:

We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements.  We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

In some circumstances we will anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.

Your rights:

Under certain circumstances, you have rights under data protection laws in relation to your personal data.

1.    Access:   The right to be provided with a copy of your personal data.

2.    Rectification:   The right to require us to correct any mistakes in your personal data.

3.   To be forgotten:  The right to require us to delete your personal data - in certain situations.

4.  Restriction of processing:  The right to require us to restrict processing of your personal data - in certain circumstances, eg, if you contest the accuracy of the data.

5.    Data portability:  The right to receive the personal data you provided to us, in a structured, commonly used and machine-readable format and/or transmit that data to a third party - in certain situations.

6.     To object:  The right to object:

      - at any time, to your personal data being processed for direct marketing (including profiling);

      - in certain other situations, to our continued processing of your personal data, eg, processing carried out for the purpose of our legitimate interests.

7.  Not to be subject to: The right not to be subject to a decision based solely on automated individual processing (including profiling) that produces legal effects decision making concerning you or similarly significantly affects you.

Exercising your rights:

If you wish to exercise any of the rights set out above, please contact us.  You will not have to pay a fee to access your personal data (or to exercise any of the other rights).  We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights).  This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it.  We may also contact you to ask you for further information in relation to your request to speed up our response.  We try to respond to all legitimate requests within one month.  Occasionally it could take us longer than a month, if your request is particularly complex or you have made a number of requests.  In this case, we will notify you and keep you updated.

We reserve the right to update this privacy notice at any time, and we will provide you with a new privacy notice when we make any substantial updates.  We may also notify you in other ways from time to time about the processing of your personal information.

It is important that the personal data we hold about you is accurate and current.  Please keep us informed if your personal data changes during your relationship with us.
